There are 8 conditions for lawful processing of personal information:
Accountability: The entity (responsible party) processing the personal information must ensure full compliance with POPIA.
Processing Limitation: Personal Information must be processed legally, minimally, and without infringing privacy. Consent or legal necessity for processing is essential. Collection of personal information must generally be done directly from the data subject.
Purpose Specification: Personal Information must be collected for specific, clearly stated, and legitimate reasons, known to the data subject.
Further Processing Limitation: Any additional processing of personal information must align with the original purpose for which the data was collected.
Information Quality: The responsible party is obligated to keep personal information accurate, complete, and up-to-date.
Openness: The responsible party must document processing activities as set out in PAIA and maintain open communication with data subjects, ensuring they are fully informed about the nature and scope of the collection of their personal information.
Security Safeguards: Proper measures must be taken to protect personal information from loss, damage, or unauthorised access.
Data Subject Participation: Data subjects (individuals and entities) have the right to access, correct, or challenge the processing of their personal information and request the deletion of improperly handled data.
