WHAT IS POPIA?

 

The Protection of Personal Information Act, 4 of 2013 (POPIA) is South Africa's primary legislation for data protection, commenced in November 2013.


It was developed in response to the increasing need for privacy regulations due to advancements in technology and data processing.

 

POPIA, which enshrines the constitutional right to privacy, sets standards for processing personal information. Although commended in 2013, key provisions of POPIA only came into effect on 1 July 2020, with a compliance deadline for individuals and businesses set for 30 June 2021.

 

POPIA is overseen by the Information Regulator, a government entity responsible for enforcing and guiding data protection practices in South Africa.
