WHO ARE THE KEY ROLE PLAYERS IN TERMS OF POPIA?
The key role players in terms of POPIA are:
Information Regulator: The key authority overseeing POPIA compliance, guiding, handling complaints, and imposing penalties for non-compliance. For instance, if there's a complaint about Signa Group's data handling, the Information Regulator investigates to ensure compliance.
Data Subject: Individuals or businesses whose personal information is collected and processed, with rights under POPIA, including access, correction, and deletion. Employees, subsidiaries, clients, and Signa Group fall under the category of data subjects.
Responsible Party: Individuals and businesses determining the purpose and means of processing personal information, are accountable for the compliance of POPIA's principles. Signa Group, for example, is a responsible party, ensuring compliance in processing employee and client data for service provision.
Operator: Third parties processing personal information on behalf of responsible parties. External entities engaged by Signa Group, like cloud service providers, may be considered operators.
Information Officer: POPIA, combined with the Promotion of Access to Information Act, 2 of 2000 (PAIA), mandates businesses to appoint and register an information officer with the Information Regulator. The information officer oversees data protection strategy and compliance, a role typically held by a senior member within Signa Group to ensure POPIA compliance.
